The jury has ruled on one of the counts an Evansville woman faced in a trial accusing her of confinement and rape charges, among others. The jury ruled 37-year-old Heidi Carter guilty of possession of a handgun without a permit, which is a misdemeanor. The other charges were not decided and those were ruled a mistrial. They will be back in court on December 9th.
Yesterday, 13 people took the stand, hours of bodycam and interrogation video were reviewed, and evidence ranging from a revolver to the tape officials say was used to restrain Timothy Ivy and his girlfriend was presented. Police say Carter met the pair on a social media site and invited them to a home on Stinson Avenue for sex and drugs. Officers say her boyfriend, Carey Hammond, came home and hit Ivy with a baseball bat and strangled him. Investigators say Carter held a gun to the woman’s head during the rape. In addition to testimony and evidence review, the prosecution announced Wednesday that one of Carter’s rape charges would be dropped. While the state pushed for a guilty verdict on all counts, the defense says that none of this would have happened if not for Hammond, and they asked the jury to decide not if Carter is innocent, but if they were firmly convinced, she was guilty.
